are silencers legal

It's perfectly legal to own a silencer if you follow thepaper traill, and pay the tax stamp. Don't go around trying to put yourself in jail by listening to some idiot telling you to buy one in a back alley or have one built. ...I was introduced to this site by fellow members at a Canadian gun forum. It turns out that silencers are legal in 34 states in the United States. I'd.Civilian sales are also up as civilians become increasingly aware that suppressor ownership is legal in 34 states. According to the AAC website, silencers are and always have been legal to own under federal law. ...Designed to fit KTM's range of SX, EXC enduro and supermoto bikes, the BOS silencer is road-legal, but features a removable baffle, called a dB eater, which liberates maximum power once taken out. Without the dB eater the BOS silencer ...So the question is can i just buy the silencer from a dealer online and pay the tax stamp and be done or is there more hoops to be jumped through? Are the tax stamps automatically approved if you are legal without anymore hassle? ...When asked what I should do to make it legal he said remove the foam or cut in half and throw it away. They did not hassle me about the silencer as we removed the foam post haste and they had other things on their minds. ...In 2005, Sisters in Islam , a member of JAG submitted a memorandum to the Government to reiterate its call for the Syariah Criminal Offences laws to be repealed on the grounds that they have no basis in Islamic legal theory and practice ...are gun silencers legal in va??? first, the correct nomenclature for this device is suppressor, not 'silencer' ... contrary to the uneducated answers of the ill-informed prior answerers, any law ... answers.yahoo.com/question/index?qid= ...However, silencers are not mentioned in the statue, but that does not make it legal to possess a silencer in South Carolina. In order to possess Title II weapons you must comply with state and federal law. While South Carolina law does ...Silencers are legal in 37 other states and ATF approval to own them is routine. You will still be required to pay the $200 tax for each one you make or buy. You must be at least 18 years old to make or buy from a person in your state, ...
I know it is illegal to have a muzzle or detachable silencer but how about a permanent silencer such as ones built in the barrel of firearms

are silencers illegal in Western Australia for a .177 or .22 air rifle?

All I know about this is that california prohibits detachable muzzle silencers,But does it prohibit detachable barrels that cause the sound to be reduced?

I know you require a cat to pass the mot emmissions test but is it legal to remove the cat after you have passed the mot. I know you will have to fit it again for the next mot but I would like to decat my exhaust and don't want to ge done by the cops for not having one also I no you can get done by the cops for not have a rear silencer is it the same for cats too. Thanks in advance.

after i buy a gun i am interested to know if i can get a silencer for a .22lr rifle for rabbit hunting purposes so they don't run away after 1 shot?

thnx any info on silencers would be good too

also im almost certain its legal in Australia because it has a permit but i want to know if it is for rabbit hunting purposes.

if not the case please explain

How does one create a homemade suppressor, i am not asking whether it is illegal or not! i am not asking whether or not i can do it! i am not asking for the stupid potato idea! i am not asking for a coke bottle over the barrel! i am not asking for the redundant and stupid moron idea of a silencer for an air gun, airsoft, bb gun, pellet gun, or paint ball gun! i do not need to know anything about the legal issues or any paperwork or tax or fee. i simply am asking how or where ONLINE i can learn to build a military grade professional as can be suppressor. does anyone know how to build one or perhaps where i can at least find a blueprint for one without buying anything? p.s. the blueprint or any other outside info must be an online resource that i can access without buying anything or subscribing to any form of club, subscription, or magazine. be aware that i have no money whatsoever, only the actual means and tools to create the suppressor. so don't give me any info on buying something unless it is actual material for the silencer. do not tell me it is illegal, i don't need that information.
does anyone have the balls to answer the question?

Well I plan on getting a cheap ruger 22 from my local gun store, obviously I have to fill out the form they give me and have them call in for a background check, but I also plan on changing alot of the accessories.. I want to change the stock to an m4 style stock, or whatever looks cooler to me, get a few 20-50 round banana clips, depending on what I can find, add a front verticle grip, maybe a bipod, and of course top it off with either a scope or some sort of red/green dot sight.

My question is really, to modify a gun or do anything that I would like to do, do I have to fill out any more forms or anything at all to make it completely legal. Is there anything like the process of getting a silencer, where there is a waiting period and a 200$ tax stamp or something of that sort.

I live in New York (not in NYC, or any other city for that matter)

I don't actually live in the US, I'm Aussie through and through, but I'm just curious. Do they sell silencers for pistols in the US legally and if so is it legal to carry a silenced pistol around?

If so, please tell me where I can buy them, online or not, and if they actually suppress anything, or just look cool, also please give me your opinion on these Youtube videos that show you how to make one yourself, and any other information I might need regarding the subject.

I currently got a rage exhaust with an adjustable silencer on my 1989 toyota celica gtr. With the silencer open its 93 Db, with it shut is 90 Db. Now its getting built up with carbon so hopefully should be going a bit quieter.
Does it matter of the year of the vehicle?
Will this pass a New Zealand WOF (Warrent Of Fitness)?

I didnt intend for it to be loud, you dont know until you buy it, the exhaust shop who fitted says its legal but others say it might not.
Im not a boyracer by the way ;)

i have a luger mk 3 (22 LR)

From what I've googled, silencers on paintball markers are ambiguous when it comes to legality. Illegal in the USA, but legal in Canada. I live in the UK, and would like to know if I can legally make myself a silencer for a paintball marker. Thanks!

It doesnt matter if they're legal or not.
Real answers please.

i know this question has been asked millions of times because nobody wants to get in troube with the ATF. i have read blogs about the topic and some suggest that it is perfectly legal to make and attach, others say its illigal and that im an idiot, and some say that you need a tax stamp to do it. i just want to know if the ATF will even bother sending me a tax stamp and then its 200$ so i could just go and buy the gamo whisper with a silecer! it doesnt make much sence at all to me. i have heard discussions that as long as it can not be taken off and always stays on the gun, than its legal and you dont need a tax stamp. someone help. im going hunting soon (in a week) and wanted to know realy badly. if you work for the ATF that would be exelent. but im open to any other answers!

i want to remove the rear silencer and put a straight through pipe on my car so u can hear the real noise of my engine but want want 2 make sure it is legal first before i do.???

i got a no-brand n1 style muffler on my 92 civic thats kinda loud when theres no silencer...
i wana know if its legal when i don't have the silencer on it .
how do cops know if its legal or not
is there a carb sticker on it

I want to get rid of squirrels in my yard, but I don't want freak neighbors out
Well I did try a pellet gun but I guess it is not strong enough, they just run away then come back like 5 minutes later.

I know some weapons in most states are banned completely because they have been determined to serve no legal purpose. Machine guns, Short barreled shotguns, silencers, metal knuckles, billy clubs, or a?bludgeonsa? are on the list but it is unclear if telescoping or collapsible batons are considered as part of that list. Does anyone know if they are. I have NO intention of ever leaving the house with it, but that may not matter.
I checked the State of Michigan penal code and that weapon is illegal to possess. So... a baseball bat it is. Thanks everyone for contributing.

I'm in the process of making a suppressor/silencer for my paintball gun and I know that these are illegal in the U.S. but obviously laws change from country to country. So if I made a paintball silencer, would I be able to use it at the paintball park?

PS: I live in Manitoba

I have a 9MM CX4 Storm. I want to put a silencer on it. I know all about the legal stuff and how you have to go about getting a silencer, so i just want to know how i will have to modify the gun to put a silencer on it.

I know its illegal to have/make a real silencer for a gun in the US, and I don't know why you would want this if its illegal to have a silencer, but is it legal to have 14mm threads on the end of your gun. are there any gun companies that have threads on the end of the guns when you buy them. Or would you have to modify them somehow
lol sorry, I totally forgot the word supressor but whatever right

im moving to Oklahoma and i wanted to know if i can own a silencer? would it be lawful for me to use a silencer on a pistol? i know some states alloe ownership of silencers but not on actual usage of it. Would i need a license for a silence rin OK?

Way to go Montana!!!!!!

You can googlea.new Montana gun law for a check

Looks like we have a Constitutional challenge.

Montana Governor Signs New Gun Law Executive Summary

The USA state of Montana has signed into power a
revolutionary gun law. I mean REVOLUTIONARY. The State of
Montana has defied the federal government and their gun
laws. This will prompt a showdown between the federal
government and the State of Montana. The federal government
fears citizens owning guns. They try to curtail what types
of guns they can own. The gun control laws all have one
common goal - confiscation of privately owned firearms.

Montana has gone beyond drawing a line in the sand.
They have challenged the Federal Government. The fed
now either takes them on and risks them saying the federal
agents have no right to violate their state gun
laws and arrest the federal agents that try to enforce the
federal firearms acts. This will be a world-class event to
watch.

Montana could go to voting for secession from the union,
which is really throwing the gauntlet in Obama's face.
If the federal government does nothing they lose face.

Gotta love it.

Important Points -

If guns and ammunition are manufactured inside the State
of Montana for sale and use inside that state then the
federal firearms laws have no applicability since the
federal government only has the power to control commerce
across state lines.

Montana has the law on their side. Since when did the USA
start following their own laws especially the constitution
of the USA, the very document that empowers the USA.

Silencers made in Montana and sold in Montana would be
fully legal and not registered. As a note silencers were
first used before the 007 movies as a device to enable one
to hunt without disturbing neighbors and scaring game.

They were also useful as devices to control noise when
practicing so as to not disturb the neighbors.

Silencers work best with a bolt-action rifle. There is a
long barrel and the chamber is closed tight so as to direct
all the gases though the silencer at the tip of the barrel.
Semi-auto pistols and revolvers do not really muffle the
sound very well except on the silver screen.

The revolvers bleed gas out with the sound all over the
place. The semi-auto pistols bleed the gases out when the
slide recoils back.

Silencers are maybe nice for snipers picking off enemy
soldiers even though they reduce velocity but not very
practical for hit men shooting pistols in crowded places.
Silencers were useful tools for gun enthusiasts and hunters.

There would be no firearm registration, serial numbers,
criminal records check, waiting periods or paperwork
required. So in a short period of time there would be
millions and millions of unregistered untraceable guns in
Montana.

Discussion-

Let us see what Obama does. If he hits Montana hard they
will probably vote to secede from the USA.

The governor of Texas has already been refusing Federal
money because he does not want to agree to the conditions
that go with it and he has been saying secession is a right
they have as sort of a threat. Things are no longer the
same with the USA.

Do not be deceived by Obama acting as if all is the same,
it is not.

Text of the New Law
HOUSE BILL NO. 246 INTRODUCED; BY J. BONIEK, BENNETT,
BUTCHER, CURTISS, RANDALL, WARBURTON

AN ACT EXEMPTING FROM FEDERAL REGULATION UNDER THE
COMMERCE CLAUSE OF THE CONSTITUTION OF THE UNITED STATES A
FIREARM, A FIREARM ACCESSORY, OR AMMUNITION MANUFACTURED AD
RETAINED IN MONTANA; AND PROVIDING AN APPLICABILITY DATE.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MONTANA:

Section 1.
Short title. [Sections 1 through 6] may be cited as the
"Montana Firearms Freedom Act".

Section 2.
Legislative declarations of authority. The legislature
declares that the authority for [sections 1 through 6] is

(1) The 10th amendment to the United States Constitution
guarantees to the states and their people all powers not
granted to the federal government elsewhere in the
constitution and reserves to the state and people of Montana
certain powers as they were understood at the time that
Montana was admitted to statehood in 1889. The guaranty of
those powers is a matter of contract between the state and
people of Montana and the United States as of the time that
the compact with the United States was agreed upon and
adopted by Montana and the United States in 1889.

(2)The ninth amendment to the United States constitution
guarantees to the people rights not granted in the
Constitution and reserves to the people of Montana certain

i didn't write this

it was sent to me in an email

i didn't change the wording because frankly, i didn't feel like it

If the bike has headlights, high beams and low beams and turn signals and a horn it should be able to be registered as a LSV low speed vehicle.

it can be registered for street use in many states. Most of our customers who have wanted to register these bikes for street use have been able to do so. You may need to add a license plate holder and/or rear-view mirrors, or other minor modifications. These items are inexpensive, can be found at most local scooter or motorcycle shops, and are easily attached via simple modifications.

All vehicle(s) come with a factory standard Certificate of Origin (Manufacturer Statement of Origin/MSO) which may be used for registration. We also include an official MSO for registration, with no extra charge for this service.

^^From what the site says ..the bigger super bike that i am getting, not to be confused with the smaller 50 cc models should be able to be street legal.

These are the rules in Florida...but i am in PA hopefully it is the same.

0. Have a motorcycle licence ( for a 110cc it is classified as a motorcycle)- you could try to say to say its 50cc then you dont need one but the certificate will probably say its 110cc.. You will not be required to bring the bike in to the DMV or ever do a riding test for anyone.
1. Headlights, taillights, sideview mirrors, signals, licence plate holder
2. Helmet- if you plan on not buying insurance ( you will defenetally not want to pay the price of the bike each month just on insurance r u nuts!!)
If you dont use helmet, you must have insurance. Cops can pull u over if you ride on streets where there will defenetally be cops, local neihborhood driving you can do without helmet with no cops near.)
3. Bring your factory standard Certificate of Origin (Manufacturer Statement of Origin/MSO) it is the important paperwork the bike comes with
4. Bring your ID
5. Bring $ it will cost $30.00 to put a Licence plate on it which includes the years stickers ( you will have to pay extra each year for new stickers)
6. Bring another $29.75 to get the bike registered
7, Bring some more money of 7% extra of the original purchase price. ( so if bike was bought for $500.00 you will have to pay extra $35.00 at the DMV.)

FOLLOWING THESE STEPS WILL GUARANTEE YOU TO LEGALLY RIDE ON ANY of the X series Mid Bikes( with minor modifications) on PUBLIC ROAD ( except highway)

so a total of about at least $100.00 of registration fees, not including your modification fees is all thats required to ride the bike legally.

BTW: it may sound like im answering my own question but im not about to drop 700 bucks on a super bike and not be able to ride it.

thanks.

I know that you can legally purchase a permit to buy a sound suppressor from ATF and that you must have a permit for each silencer you buy, I want to know if it is legal or not to carry concealed your legal handgun with Concealed weapons permit with your silencer attached to that same pistol, so long as you have both your concealed weapons card & ATF certification for a silencer on hand?

Hi there,I live in TX of the US now,and I wanna buy a silencer for my air rifle(AA S410).When I searched silencers on google, all of the silencer shops were in the UK...Is it legal to own a silencer for an air rifle in the US?If so,where can I buy the silencer online?Thx:)

My husband and I have 2 very nasty neighbors who each have small yippety dogs that bark CONSTANTLY! From 8AM until sundown, all that I hear through my windows is "yip yip yip".

One of them keeps an electric fence collar on hers (most of the time, but I occasionally catch her roaming in our yard, digging holes), the other does not. Every day when I am out working in the yard, one of the dogs runs up to me, and barks incessantly. This triggers the other dog to bark. Sometimes when the barking seems very close to my house I go outside and need to chase the dog off of my deck and back into her yard, while she barks the whole way. I can't have a minute of peace in my own yard or house!

We have a large breed dog who, in turn, does NOT bark. He is kept on a runner so he cannot leave our yard. The small dog instigates and teases our dog by running circles around him.

I have tried scolding the dog and throwing small rocks at her to scare her (not to hit her), but it only deters her for a minute before she comes running back.

I can assure you that speaking to each of these neighbors will do no good. They are ignorant, selfish people and will probably find a way to blame me for their dog's barking. I believe that they simply filter out the barking because it is so constant. I, however, refuse to and do not feel that I should suffer due to their lack of training. I confronted one of them last year when her dog dug an enormous hole in one of our mulch beds. She yelled at ME, then sent her son over to do a half a** job filling the hole. If my dog ever did that in her yard, we would never hear the end of it!

I have considered using the Dog Silencer Pro to stop my neighbor's dogs from barking, however I do not want my dog to suffer when the ultrasonic frequencies (inaudible to humans) go off.

I have a few questions. How do I keep this dog out of my yard? How can I get both of these dogs to stop barking? What are the legal limitations for use of deterrents on MY property to keep the other dog out? I want something that will work, but I do not want the MSPCA knocking at my door.
We have a very large yard, and to put up a fence big enough to keep the dogs out it would cost over $12,000... I know, good fences make good neighbors. And I'd love to keep the neighbors out just as much as their dogs, haha

Got a ticket for "loud engine exhaust" and looking to fight it, although I have a aftermarket muffler it has a silencer on it. The noise is coming from a crack on the exhaust pipe.

I know that they can be legal if you have the right licenses, but they cost too much unless your in it full time as a job, and then you can probably make one anyway. I just got curious, because I don't see how a buisiness could survive in that market, given how few people they have to sell to, and probably even fewer legit(legal) buyers.
I am assuming that they are private sector companies, so they would have to make some profit.

Where can i get one? if anyone knows let me no please

It is legal where i live.

Is it illegal to put a fake silencer on a real gun? Lets say in the USA. Also if it is legal could you hunt with the fake silencer attached?

I just want a trust so that way I can allow my family members to be able to use the same device without the legal hassle.

Info on states would be helpful. What I'm really asking is if its possible to buy a rifle at a gun show privately without any strings attached/ government involved? In addition, I may want to buy a silencer to go with it; not sure yet. But can the sound suppressor also be purchased used from an individal legally? Thanks.

I have a Browning Buckmark .22 pistol... would these bullets (29grains at 700fps) be so queit that i wouldnt have to wear hearing protection? And also why dont they make a semi auto gun that shoots these? Im sure they could make the action weak enough so they would cycle right? It would be even queiter with a silencer. Ive seen a vid of those being shot through a silencer. Would it be legal for civilians (minus the paperwork and effort to get a silencer)? I was thinking of a MP7 type format they could make it in. Thanks
also ive cycled subsonic 40 grain ammo through my gun before (though sometimes it didnt cycle).

I've heard that weapons silencers can be bought, if you can get the license from your local or state law enforcement agencies approve your permit to own and store one.

I know it's illegal to build suppressors for fire arms unless you register it which takes ALOT of time, paper work, and problems. But i want to build suppressor for my AirForce Condor .22cal Air rifle which is Very loud. So is it legal to silence your air rifle?????? Some air rifles sold with build in suppressors and you can buy them without any problem or paper work.

I am looking to buy a legal silencer for a .45 or 9mm. I am not part of any law enforcement and would like to know if it is possible (and legal) for a civilian to own one. Can you also tell me where to purchase one (if legal, of course).

I have seen various web sites with blue prints and instructions to build a railgun as well as a few videos on youtube showing a homemade railgun. I am fairly familiar with US firearm laws, as I had to study a few for a firearms safety class and I know that creating a firearm is illegal unless you have consent. However, under US law (18 U.S.C. 921) a "firearm" is:

(3) (a) - any weapon (including a starter gun) which will or is designed to or may readily be converted to expel a projectile by the action of an explosive;

(3) (b) - the frame or receiver of any such weapon;

(3) (c) - any firearm muffler or firearm silencer; or

(3) (d) - any destructive device. Such term does not include an antique firearm.

So, with that definition a railgun is not considered a firearm because it does not use explosive force, it uses electromagnetic force to propel the projectile.

Now, it also says that a "firearm" is "any destructive device" which defined by law under (18 U.S.C. 921) is the following:

(4) (A) - any explosive, incendiary, or poison gasa

(4) (A) (i) - bomb,

(4) (A) (ii) - grenade,

(4) (A) (iii) - rocket having a propellant charge of more than four ounces,

(4) (A) (iv) - missile having an explosive or incendiary charge of more than one-quarter ounce,

(4) (A) (v) - mine, or

(4) (A) (iv) - device similar to any of the devices described in the preceding clauses;

(4) (B) - any type of weapon (other than a shotgun or a shotgun shell which the Attorney General finds is generally recognized as particularly suitable for sporting purposes) by whatever name known which will, or which may be readily converted to, expel a projectile by the action of an explosive or other propellant, and which has any barrel with a bore of more than one-half inch in diameter; and

(4) (C) any combination of parts either designed or intended for use in converting any device into any destructive device described in subparagraph (A) or (B) and from which a destructive device may be readily assembled.

The term a?destructive devicea? shall not include any device which is neither designed nor redesigned for use as a weapon; any device, although originally designed for use as a weapon, which is redesigned for use as a signaling, pyrotechnic, line throwing, safety, or similar device; surplus ordnance sold, loaned, or given by the Secretary of the Army pursuant to the provisions of section 4684 (2), 4685, or 4686 of title 10; or any other device which the Attorney General finds is not likely to be used as a weapon, is an antique, or is a rifle which the owner intends to use solely for sporting, recreational or cultural purposes.

To me it seems like it would be perfectly legal since a railgun uses electromagnetism as opposed to "explosive force" to propel the projectile and the law only regulates "firearms" which by law only covers a weapon designed to expel a projectile by explosive force...

It just seems like kind of a dangerous thing for someone to be able to legally make with no authorization or consent from a government agency.. Is this really legal?

I was looking at one of the Remingtons but I wanted to know if they were any good. Which model would you recommend? How much ammo do rifles usually hold?

And is there such a thing as a rifle silencer and is it legal?

I live in Ohio. The silencers will not be able to be used on lethal firearms due to the fact that the pressure would shatter the silencer. If you need any more info, ask below then ill post it. Thank you in advance for your help.

I know airsoft guns are illegal, but what about the suppressors they make for them? I'm chasing a prop silencer for a short film and such a thing would be just the ticket--but I don't know if I'd be allowed to import. Anyone know for sure?

I don't no why but some people say airgun are ok to put silencer on even if i lived in USA but not on real firearm without a stamp. I don't get it. I lived in the US in California. Plz help if u Know.

under the national firearms act, silencers and short barrel rifles (any rifle under 16 inches long barrel or under 28 inches total length) are both "title 2" weapons or whatever. both need approval from ATF to own, lotta paperwork, and cost $200 transfer tax or something like that.

so if i shortened the barrel on, say an AK47 with ATF approval, paid my $200 tax, then decided to put a silencer on the same gun, could i get ATF approval for that? also, do i have to pay another $200 for it? is it legal to have a combination of title 2 weapons?
